Montana

Montana leaves the decision of whether to elect or appoint a county attorney to each county. It also allows local officials to decide whether to hold non-partisan primary elections if fewer than three candidates run for the office of county attorney. The vast majority of Montana’s 56 counties elect their county attorneys and approximately two thirds of those county attorneys are elected in partisan elections. County attorneys serve four-year terms.
